Florida’s Section 5311 sub-recipient agencies must adopt one of two FDOT model substance abuse policies. Employees or applicants who violate the drug and alcohol testing program by testing positive or refusing a DOT required drug or alcohol test must be immediately removed from safety sensitive duty and provided a referral to a qualified Substance Abuse Professional. This Second Chance version of the model policy provides for an employee to return to duty after taking the necessary steps to seek evaluation by a qualified Substance Abuse Professional and participate in all of the prescribed treatment. Additionally, employees who return to duty after violating the policy must remain in a follow-up testing program, as established by a qualified Substance Abuse Professional. Download Document
